Terms and Conditions

§1. General

 

(1) These terms and conditions apply to all contracts, deliveries and other services of the company: Nicks Asian Shop, Sittadstrasse 54 A, 41061 Mönchengladbach (hereinafter: "saleswoman"), concerning the online shop: www.nicks-asianshop.de and all belonging to the domain Sub-domains. Deviating provisions of the customer do not apply, unless the seller has confirmed this in writing. Individual agreements between the seller and the customer always have priority.

(2) The seller offers customers in the online shop: www.nicks-asianshop.com new seeds from all over the world and gifts

 

§2 contract conclusion


(1) The contract is concluded by a confirmation of acceptance by the seller. The customer makes an offer to the seller by inserting the asuware into the shopping cart and clicking on the "buy" "order button".

(2) The customer also has the option of requesting certain items online or by e - mail, or by letter from the seller. After receiving such a request, the seller will submit a corresponding offer to the customer by e-mail, online or by letter. A contract is only concluded when the customer accepts this offer.


(3) The customer will receive the contracted text by invoice with the order.


§3 prices, shipping costs, payment method, dunning fees

(1) When ordering via the online shop, the price stated there, all prices are final.

(2) The resulting delivery and shipping costs are indicated in the table in the shopping cart.

(3) The delivery to the customer by the seller is made at the request of the customer against the following payment methods: Prepayment by Paypal, advance payment by Sofortüberweisung, advance payment by bank transfer, advance payment by scripe, payment on collection, subsequent payment by invoice will be granted only to long-standing customers.

(4) If the customer chooses advance payment by bank transfer, the payment is due within 7 calendar days after conclusion of the contract at the latest.


(5) If a customer defaults on its payment obligations, the seller may claim damages in accordance with the statutory provisions and / or withdraw from the contract.

(6) The seller shall always issue an invoice to the customer, which will be handed to him upon delivery of the goods or received online in text form.

§4 delivery, transfer of risk

(1) Unless agreed otherwise, the ordered goods will be delivered to the address specified by the customer. Delivery will be made from the Seller's warehouse . A pickup of the goods against cash payment is also possible after prior appointment.

(2) The seller reserves the right to make a partial delivery, if this appears advantageous for a speedy settlement and the partial delivery is not unacceptable for the customer exceptionally. Additional costs resulting from partial deliveries will not be charged to the customer.


(3) We ship to all countries worldwide, the corresponding delivery times are noted.

§5 right of withdrawal

Customers who are consumers in the sense of §13 BGB are entitled to a legal right of withdrawal. Information can be found in the cancellation policy.

§6 warranty

Insofar as defects exist, the customer is entitled to the statutory warranty right in accordance with the following provisions. If only traders are involved in the contract, §§ 377 et seq. HGB apply in addition

§7 Final provisions

(1) The law of the Federal Republic of Germany applies. Compulsory provisions of the state in which you have your usual stay remain unaffected.

(2) If the customer is a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the domicile of the provider.

(3) Customers have the opportunity to use an alternative dispute resolution. The following link from the EU Commission (also known as the OS platform) contains information on online dispute resolution and serves as a focal point for the out - of - court settlement of disputes arising from online sales contracts: https://ec.europa.eu/consumers/ odr.

Information required. Consumer Dispute Settlement Act (§36 VSBG): The seller is neither willing nor obliged to participate in further dispute resolution proceedings before a consumer arbitration board.
